Terms of Service

Welcome to Quevo ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Quevo platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of the Service

Quevo provides a self check-in and queue management system for walk-in businesses. The Service includes:

  • For Business Owners ("Subscribers"): A web dashboard for managing locations, providers, analytics, and billing, along with iPad applications for customer check-in (Kiosk) and queue management (Admin).
  • For Customers ("End Users"): A self check-in experience via the Kiosk app, including queue status updates delivered via SMS.
3. Account Registration

To use the Service as a Subscriber, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Billing
  • Free Plan: New Subscribers can start with our free Starter plan, which includes limited features. No credit card is required.
  • Billing: Paid subscription plans are billed monthly through Stripe, our payment processor. By providing a payment method, you authorize us to charge the applicable fees.
  • Cancellation: You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
  • Plan Limits: Each subscription plan includes limits on the number of locations, providers, and monthly check-ins. Usage beyond your plan limits may be restricted.
5. Subscriber Responsibilities

As a Subscriber, you agree to:

  • Use the Service in compliance with all applicable local, state, and federal laws.
  • Obtain appropriate consent from your customers before collecting their personal information through the Kiosk app.
  • Not use the Service to send unsolicited or spam communications to customers.
  • Ensure that devices running the Kiosk and Admin apps are appropriately secured.
  • Provide accurate business information, including location details and provider information.
6. End User Responsibilities

As an End User of the check-in system, you agree to:

  • Provide accurate and complete information during the check-in process.
  • Keep your contact information up to date.
  • Not misuse the Service, including submitting false information or disrupting the queue.
7. SMS Communications

The Service sends transactional SMS messages to End Users regarding queue status updates (e.g., when it is their turn). By checking in through the Kiosk, End Users consent to receive these messages. Subscribers may also enable promotional SMS messages, subject to applicable opt-in requirements.

  • Message frequency varies based on check-in activity.
  • Message and data rates may apply.
  • End Users may opt out of promotional messages at any time by replying STOP. Transactional messages related to an active check-in cannot be opted out of.
  • Reply HELP for assistance.
8. Intellectual Property

The Service, including all software, design, text, graphics, and other content, is owned by Quevo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Quevo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Quevo, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association in Florida, USA. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We may update these Terms from time to time. We will notify Subscribers of material changes via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Florida, USA, without regard to its conflict of law principles.
